EXTRADITION

The Attorney General is the Central Authority for Brunei Darussalam in all extradition matters. The Central Authority is responsible for receiving, handling and processing extradition requests in accordance with the provisions of the Extradition Act (Chapter 294), the Extradition (Malaysia and Singapore) Act (Chapter 154), the Summonses and Warrants (Special Provisions) Act (Chapter 155) and any applicable extradition treaty.

Requests for extradition are to be transmitted by the central authority of the requesting State through diplomatic channels to the Attorney General of Brunei Darussalam at the following address:

Where Brunei Darussalam has concluded an extradition treaty or other applicable arrangement with a requesting State, requests should be transmitted in accordance with the procedures specified in the relevant treaty or arrangement.

Where no extradition treaty exists, requests may nevertheless be considered in accordance with the provisions of the Extradition Act (Chapter 294), including where the Attorney General certifies a country as an extradition country for the purposes of a particular request.

In urgent cases, a requesting State may seek the provisional arrest of a person pending the submission of a formal extradition request, subject to the requirements of the applicable legislation.

Extradition Arrangements with Malaysia and Singapore

Brunei Darussalam maintains special extradition arrangements with Malaysia and Singapore under the Extradition (Malaysia and Singapore) Act (Chapter 154). The Act provides a simplified legal framework for the surrender of fugitive offenders between the three countries, reflecting the close cooperation and longstanding legal arrangements between Brunei Darussalam, Malaysia and Singapore. Requests made under these arrangements are governed by the provisions of the Act and any applicable procedures agreed between the respective authorities.

Extradition Requests from Commonwealth Countries

Brunei Darussalam maintains extradition arrangements with Commonwealth countries under the Extradition Act (Chapter 294). The Act provides the legal framework for the surrender of fugitive offenders between Brunei Darussalam and Commonwealth countries. Requests made under these arrangements are governed by the provisions of the Act and any applicable procedures governing extradition requests from Commonwealth countries.
